practise.

I cannot conceive of any competent

soliciter at present briefing them in any case which he was allowed to take himself. He would do it undoubtedly much

better than they could.

There can be, I submit, no denial of

opportunity to the junior Bar when the juniors are not seek-

-ing that opportunity or endeavouring to fit themselves to

take it when it comes

The defect of the present system is that the costs of a small action under present conditions are so

high as to be pratically prohibitive. I have always felt it a blot upon our administration that a litigant to recover a

sum of say 84,000 should be compelled to disburse another

84,000 for his costs, yet that is the case under our present

system.

I am not implying that the remuneration

of either counsel or solicitors is in such small actions

always too high. The work involved may be very considerable.

But the practice in Original Jurisdiction is far more lengthy

and formal than in Summary; where short custs are encouraged

and solicitors may apply in Chambers without the necessity

of a formal etmons. The result is that many of these actions

are settled out of Court.

Frequently the plaintiff only does so

most unwillingly and at the price of ☀ relinquishing a great

part of his claim. He settles because he is wearied of the

delay and troubled by the expense that he finds necessary

before he can get a decision.

Again, solicitors have frequently told me

that they have advised their clients not to gue, but to

compromise a perfectly just claim at some loss rather than
